General Terms & Conditions
Effective as of 5 August 2024.
Important information: please read this information before you move on to the remainder of these terms and conditions.
Everything contained in the Terms of Use (see section 2.4 below for how "Terms of Use" is defined) is important and should be read by you, but we would like to draw your attention in particular to the following sections and the important terms and conditions that they contain. It is important that you read the sections themselves and not rely on the short summaries below:
- Section 2 – you are entering a binding contract: By registering for a Player Account (defined in section 4 below) and/or accessing or using any part of the Services (defined in section 4 below) you are entering into a legally binding contract. That contract is between you and us and it incorporates all the terms, conditions and documents forming the "Terms of Use" (explained and defined in section 2.4 below). Please read section 2 carefully.
- Section 6 – Player Requirements: You must meet certain age and other eligibility criteria and requirements to register for a Player Account and use the Services and, when you do those things, you will be making certain promises to us on which we're entitled to rely. Please read sections 6.1 and 6.2 carefully.
- Section 6 – Prohibited Activities: We will not tolerate fraudulent activity, collusion, cheating or any other "Prohibited Activities" (defined in section 6.3 below). If you do any of these things, we will have certain rights, including the right to suspend and, ultimately, close your Player Account, to cancel/void your bets and/or to withhold funds (including winnings). You may also be required to compensate us for losses suffered by us as a result of you engaging in a Prohibited Activity. Please read sections 6.3 and 6.4 carefully.
- Section 6 – Verification Checks: We will need to complete our Verification Checks (defined in section 6.8) before you can do certain things in connection with your Player Account. We may also run Verification Checks on an ongoing basis after your Player Account has been opened. If we're unable to complete our Verification Checks to our reasonable satisfaction, we will have the right to suspend and, ultimately, to close your Player Account, and we may pass on any necessary information to the relevant authorities. Please read sections 6.8 and 6.9 carefully.
- Section 7.10 – Duplicate Player Accounts: You may only register for one Player Account. If we discover that you have opened more than one Player Account (which we call a "Duplicate Player Account"), we will have certain rights, including the right to close your Duplicate Player Account/s (and in some circumstances your original Player Account too) and to void bets/wagers, bonuses and/or Winnings. Please read section 7.10 carefully.
- Section 13 – Withdrawals: You will usually be able to withdraw your available Cash Balance at any time, but there are certain circumstances in which we will be entitled to delay or withhold withdrawals. Please read section 13 carefully.
- Sections 14. 15 and 16 – Bets on the Outcome of Lotteries: These sections set out (a) the special rules that apply when you bet on the outcome (i.e., result) of an official and/or state-run lottery, (b) special/important terms that relate to Winnings from bets made on the outcome of lotteries, and (c) the supplemental (i.e., additional) game terms that apply to bets made on the outcome of lotteries. Please read sections 14, 15, and 16 carefully.
- Section 21 - Suspension and Closure of Player Accounts: We have the right to suspend and close your Player Account under certain circumstances (including if you engage in any Prohibited Activities, but also on advance notice). If you have engaged in illegal or Prohibited Activities, we will have the right to cancel/void attributable transactions and/or to withhold funds (including Winnings). Please read section 21 carefully.
- Section 25 - Limitations on our Liability: In certain circumstances, our liability to you is limited or excluded: When you access and use the Services, it is important that you understand what we are liable for, when limits to our liability will apply (and what those limits are), and what we are not liable for. It is also important that you understand that we will not be liable to you under these Terms of Use, and nor do we owe you a duty of care, in respect of our compliance or otherwise with any regulatory obligations that we may be under from time to time. Please read section 25 carefully.
- Section 27 – Maximum Winnings: Maximum winnings limits apply to bets placed on Games and Scratch Cards (as defined in section 4). This means that, regardless of the amount you stake and no matter how much you appear to have 'won', you will only be entitled to receive up to the maximum winnings limit. Please read section 27 carefully.
- Section 28 – Errors, Malfunctions, and Interruptions: If any aspect of the Services suffers an Error, Malfunction, or Interruption (as each of those terms are defined in section 4) we have certain rights including the right to void affected transactions including Winnings. This includes circumstances where the problem is not obvious to you or us and is only discovered by us when we check or verify the result of a transaction and/or gameplay retrospectively. Please read section 28 carefully.
- Actions we take for regulatory reasons. We may sometimes take actions in relation to your Player Account for regulatory reasons including where required to do so by the terms of our licence and/or a regulatory authority. These actions include running certain Verification Checks (sections 6.8 and 6.9), restricting/closing your Player Account (section 21.3), and preventing you from taking up promotions and/or completing promotions (section 26.3). Please read these sections carefully.

WHO WE ARE AND WHAT WE OFFER
- Lottomart is the trading name of Maple International Ventures Limited, a company registered in Gibraltar with registration number 115236 and whose registered address is Suite 23, Portland House, Gibraltar. Throughout these Terms and Conditions when we refer to "Lottomart", "we", "us", "our", or the "Operator" we are referring to Maple International Ventures Limited.
- Lottomart is licensed and regulated by the Gambling Commission and the Government of Gibraltar to provide the Gaming Products to customers in those jurisdictions set out at Section 1.3 below on a platform accessed by you via the Lottomart website available at www.lottomart.co.uk, uk.lottomart.app, or www.lottomart.com and any mobile applications operated by us (the "Site").
- This Site is only for use by customers located in the UK, Gibraltar, and the Crown Dependencies (the "Permitted Jurisdictions").
Notwithstanding the above, it may be illegal to access and/or use the Site (including any or all of the Gaming Products offered via the Site) when you are in certain countries including but not limited to those on the Prohibited List (as defined at Section 4 below). You are responsible for determining whether your access and/or use of the Site is compliant with the laws applicable in your jurisdiction and you confirm to us that it is not illegal for you to access and/or use the Site in the country where you are located. Internet Gambling may be illegal in the jurisdiction in which you are located; if so, you are not authorised to use any Payment Method to complete any transaction on the Site.
- To the extent that you are located in England, Wales or Scotland whilst you use the Services, we shall be deemed to be regulated by the Gambling Commission of Great Britain under licences granted by the Gambling Commission under account number 51833. https://registers.gamblingcommission.gov.uk/51833
- To the extent that you are located outside England, Wales or Scotland whilst you use the Services, we shall be deemed to be regulated by the Gibraltar Gambling Commissioner under licence numbers 109 and 110 granted by the Gibraltar Gambling Division.
- In addition to the Gaming Products offered on the Site, you can register for and access your Player Account, make purchases and withdrawals, participate in our Diamond Club, participate in promotions and gain access to information in accordance with these Terms and Conditions (collectively with the Gaming Products and the Site, the "Services"). This list of Services is not exhaustive and additional services may be offered by us, or we may cease to offer certain Services, from time to time.

TERMS OF USE AND YOUR RELATIONSHIP WITH US
- Please read these Terms of Use carefully before using the Site or the Services, because (as explained above) they form a legally binding agreement between you and us and they explain how our Site works, how you may use our Site and the Services, and our respective responsibilities and obligations when using the Site / Services.
- Before you can make use of any of our Gaming Products or Services you will need to register to become a member and open a Player Account. You can do this by clicking on any "Sign Up" button displayed on the Site and providing the required information. During the registration process you will be asked to accept these Terms and Conditions. If you do not accept these Terms and Conditions you will not be able to use our Site.
- By visiting the Site, registering for a Player Account and/or using any section of the Site and/or other aspects of the Services, you agree to be, and are, bound by the following (which govern the relationship between you and us):
- these Terms and Conditions;
- our Privacy Policy;
- any rules, terms and/or conditions applicable to specific Gaming Products displayed on the Site from time to time; and
- any terms and conditions of any promotions, bonuses or special offers which may be found on the Site from time to time ("Promotional Terms"),
(together the "Terms of Use"), as updated or changed by us from time to time.
- Your personal information will be processed in accordance with our Privacy Policy.
- In the event that there is any conflict or inconsistency between the Terms of Use, the order of priority in which the Terms of Use shall apply will be the same order in which they are listed above.

CHANGES TO THE TERMS OF USE
- We may need to change the Terms of Use from time to time for a number of reasons (including to comply with applicable laws and regulations and regulatory requirements). If we make any material changes to the Terms of Use, we will notify you through the Site.
- The most up to date Terms of Use will be available on the Site and any material updates to the Terms of Use must be accepted by you if you wish to continue using the Site. Until you accept a Terms of Use update, you will not be able to deposit, play, or otherwise use the Site. If any change is unacceptable to you, you should cease using the Site and/or close your Player Account.

DEFINITIONS
The following defined terms are used in these Terms and Conditions:
Bet has the meaning set out in the Supplemental Game Terms in section 17.
Bet Ticket means the ticket completed by you and displayed in your Player Account showing your selection of Line Bets.
Bet Ticket Pre-Order means a purchase of a Bet Ticket for a set number of future draws in relation to a particular regular Underlying Lottery draw.
Boost ("Boosted") means an optional feature that enables you to multiply all of the Line Bets displayed in your Bet Ticket in exchange for proportionately adjusted Prizes in accordance with section 15 (Chance Boost in Relation to Bets on the outcome of lotteries).
Boost Factor means the multiple by which you select to multiply all of the Line Bets displayed in your Bet Ticket and such multiple shall be used as the number by which the value of the Prizes that you could win shall be divided.
Cash Balance means any real-money balance in your Player Account from time to time;
Diamonds means virtual points earned by you in respect of real-money spent on Gaming Products and which are accrued and redeemable against subsequent purchases on applicable Gaming Products.
Diamond Club means our Diamond Club loyalty program.
Duplicate Player Account has the meaning given to section 17.10.
Error has the meaning given to section 28.3.
Excluded Lists has the meaning set out in the Supplemental Game Terms in section 17.
FATF has the meaning set out in the Supplemental Game Terms in section 17.
Gambling Commission means the Gambling Commission of Great Britain.
Games means any slot game, table game, live game, or instant win game made available on the "Game" tab of the Site.
Game Wagers means any stake wagered by you on any of the Games.
Gaming Products means the facilities offered by us for betting on the outcome of lotteries and for the playing of Games and Scratch Cards.
Hedging Partners means any insurers, underwriters, regulated partners or other third parties including EU Lotto Ltd (licenced by the Government of Gibraltar under licence numbers RGL 066 and RGL 085 and by the Gambling Commission under licence number 38991) ("EU Lotto") who we may enter into arrangements with from time to time to cover the risk associated with our liability to pay Winnings to you.
Interruption has the meaning given to section 28.3.
Jackpot has the meaning set out in the Supplemental Game Terms in section 17.
Line Bet means each custom selection of numbers, or randomly-generated quick pick selection of numbers, ordered by you in respect of a Bet.
Malfunction has the meaning given to section 28.3.
Network Player Winning Bet means any winning Bet placed on the Site in respect of which we placed the same Bet on behalf of the relevant Players with EU Lotto, and, including winning Bets introduced through a third party to EU Lotto and then placed by a third party on behalf of a player with EU Lotto.
Pay Table or Prize Table means the listing of Prize Categories or Prize Tiers and Prizes available to be won in relation to Bets placed on a particular Underlying Lottery draw or on a Scratch Card, explaining how each Prize Category can be achieved and any specific method of calculation of Winnings that applies.
Payment Card means debit card or (where regulation permits but expressly excluding Great Britain) credit card.
Payment Method means any payment method accepted by us from time to time but excluding Payment Cards.
Player(s) means a registered user of the Site and a Player or Players may be referred to as "you", "your", "user(s)", "player(s)", "customer(s)" or "member(s)".
Player Account means the individual user account created by you via the Site through which you can place Bets and/or Game Wagers and/or purchase Scratch Cards.
Prize means (i) in the case of betting on the outcome of lotteries, the applicable payout for correctly matching the winning number combination in a particular Prize Category in an Underlying Lottery draw; or, (ii) in the case of Games, the payout applicable according to the game rules for the relevant Game and the corresponding Pay Table; and (iii) in the case of a Scratch Card, the payout applicable according to the relevant Pay Table and rules for matching the corresponding win symbol combination. A Prize will be subject to adjustments and deductions before it is paid out as Winnings.
Prize Category or Prize Tier has the meaning set out in the Supplemental Game Terms in section 17.
Prohibited Activities has the meaning set out in section 6.3.
Prohibited List means any of the following: (i) any person who is located in or a citizen or resident of a country listed by FATF as a high-risk non-co-operative jurisdiction at http://www.fatf-gafi.org/countries/ under "High risk and other monitored jurisdictions: Call for action" or "High risk and other monitored jurisdictions: Other monitored jurisdictions" (as may be modified by FATF from time to time); (ii) any person listed on the financial sanctions list of HMRC at https://www.gov.uk/government/publications/financial-sanctions-consolidated-list-of-targets/consolidated-list-of-targets (as may be modified by HMRC from time to time); or (iii) any person in or a citizen or resident of the United States of America and all other jurisdictions that are from time to time not listed in the country selection menu in our player registration.
Scratch Cards means any scratch card made available on the "Scratch" tab of the Site.
Services has the meaning set out in section 1.6.
SpecialJackpot has the meaning set out in the Supplemental Game Terms in section 17.
Supplemental Game Terms means the supplemental terms that apply to Bets on the outcome of lotteries as set out in section 17 of these Terms and Conditions.
Terms and Conditions means these terms and conditions as updated or changed by us from time to time.
Type A Prize Category has the meaning set out in the Supplemental Game Terms in section 17.
Type B Prize Category has the meaning set out in the Supplemental Game Terms in section 17.
Type C Prize Category has the meaning set out in the Supplemental Game Terms in section 17.
Underlying Lottery has the meaning set out in the Supplemental Game Terms in section 17 and includes a lottery in respect of which Lottomart offers Players the opportunity to place a Bet.
Underlying Lottery Jackpot has the meaning set out in the Supplemental Game Terms in section 17.
Underlying Lottery Operator has the meaning set out in the Supplemental Game Terms in section 17.
Verification Checks has the meaning set out in section 6.8.
Winnings means the amount calculated in accordance with the Terms of Use and actually payable by us to you in respect of any EU Lotto Winning Bet, or any other Bet or any winning outcome on a Game or any winning Scratch Card after all adjustments and deductions have been made and local taxes or withholdings deducted in accordance with the Terms of Use and, for the purposes of section 17 of these Terms and Conditions only, has the meaning set out in the Supplemental Game Terms in section 17.

GENERAL
- If any provision of the Terms of Use is held to be invalid or unenforceable by any judicial or competent authority, all other provisions of the Terms of Use will remain in full force and effect and will not in any way be impaired.
- If any provision of the Terms of Use is held to be invalid or unenforceable but would be valid or enforceable if some part of the provision were deleted, the provision in question will apply to the minimum modifications necessary to make it valid and enforceable.
- In these Terms of Use, we have tried to be as clear as possible about what will happen in various situations. However, we do occasionally use expressions such as "may" or "are entitled to" in reference to rights that we may (or may not) exercise. These expressions are intended to convey the fact that the actions we may (or may not) take will depend on the exact circumstances that have arisen.
- Nothing in the Terms of Use shall create or confer any rights or other benefits in favour of any third parties not party to the Terms of Use.
- We are entitled to assign the Terms of Use, in whole or in part, to any company within our corporate group at any time provided that such assignment does not negatively affect your rights under these Terms of Use. You may not assign any of your rights or obligations under the Terms of Use.
- Your Player Account is personal; therefore, you may not transfer your rights or your obligations under these terms and conditions to another person. If you try to transfer your rights or obligations to a third party under these terms and conditions, such transfer shall be ineffective.
- If we do not insist immediately that you do anything you are required to do under these terms and conditions, or if we delay in taking steps against you in respect of your breaching the Terms of Use, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
- Any promotions, bonuses, or special offers are subject to the Terms of Use and any specific Promotional Terms which may be introduced from time to time in conjunction with the relevant promotion, bonus or special offer. In the case of a conflict between these Terms and Conditions and the Promotional Terms specific to any promotion, bonus or special offer, these Terms and Conditions will take precedence over the Promotional Terms.
- You must read and accept these Terms and Conditions before using the Site.
- The Terms of Use and any matters relating to them shall be governed by and construed in accordance with the laws of England and Wales provided that such choice of law will not deprive you of any mandatory consumer protections of your home country (if different).
- The courts of England and Wales shall have jurisdiction to hear and determine claims or disputes arising out of or in connection with the Terms of Use, your use of the Site and any matter arising therefrom, provided this will not deprive you of any mandatory consumer protections of your home country (if different) including the right to bring proceedings in the courts of your home country.

PLAYER REQUIREMENTS, ELIGIBILITY, PROHIBITED ACTIVITIES
- PLAYER REQUIREMENTS AND ELIGIBILITY
- The minimum age to use our Site is 18 but may be as high as 21. This varies by territory and is indicated to you during account registration. Underage gambling may be a criminal offence in your territory. If we discover (after you've opened a Player Account) that you are not of the minimum age required for your territory, we will close your Player Account, return any money paid by you in respect of the use of our Gaming Products and Services, and all transactions made by you, including any Winnings, will be void. We may also make a report to the relevant regulatory or law enforcement authorities.
- When you register for a Player Account and/or otherwise access or use any aspect of the Services, you will be confirming to us that:
- you are over 18 or 21, as indicated to you during your account registration;
- you acknowledge and accept that by placing Bets or Game Wagers or purchasing Scratch Cards through this Site you may, as well as winning money, lose money (including any stakes paid to us);
- none of the money you spend with us on Bets, Game Wagers or Scratch Cards originates from unlawful or criminal activities;
- you are not physically located in any jurisdiction outside of the Permitted Jurisdictions when accessing or using the Site;
- the money you spend with us on Bets, Game Wagers or purchasing Scratch Cards belongs to you;
- the information you supply to us when opening your Player Account and at any time afterwards is accurate and correct;
- you do not and will not hold more than one Player Account; and
- you are not an employee (or the spouse or dependent of an employee) of Lottomart or EU Lotto.
- PROHIBITED ACTIVITIES
- You may only use the Services, including your Player Account, for lawful purposes and in accordance with these Terms of Use. You must not engage in any activity which we define below as a "Prohibited Activity" and you acknowledge and understand that the consequences of you doing so will (depending on the specific circumstances) include the voiding of any relevant transactions, the withholding of any attributable Winnings, and the suspension and/or closure of your Player Account. You may also be required to compensate us for losses suffered by us as a result of you engaging in a Prohibited Activity. The following activities are strictly prohibited (each being a "Prohibited Activity"):
- collusion with other persons;
- using unfair advantage or influence or cheating, including taking advantage of any fault, loophole, bug, glitch, failure or error in our software or systems or on our Site;
- the use of automated players, bots or artificial intelligence to conduct activities on the Site or otherwise through any Player Account;
- exploitation of any Error, Malfunction, or Interruption;
- using the Site in a fraudulent manner or for an illegal, unlawful or improper purpose or undertaking any other fraudulent activities in relation to any Bet or Game Wager or Scratch Card, the operation of any Player Account or other use of the Site;
- maintaining more than one Player Account or creating duplicate or multiple Player Accounts, utilising a Player Account belonging to someone else or allowing someone else to place Bets or Game Wagers or purchase Scratch Cards using your Player Account;
- manipulation of our software, systems, Site or Gaming Products;
- any technical form of abuse of our software, systems, Site or Gaming Products;
- any other behaviour which amounts to deliberate cheating or bonus or promotion abuse including any non-compliance with our Promotional Terms;
- providing us with false, misleading, incomplete or inaccurate information in connection with your Player Account, any Payment Cards or Payment Methods or otherwise in connection with the Site or services available through it;
- placing Bets or Game Wagers or purchasing Scratch Cards at a time when you are less than the minimum required for your territory (at least 18 or 21 years old);
- using the Site for professional, business or commercial purposes;
- using, or attempting to use, the Site from any country that is not a Permitted Jurisdiction including but not limited to those on the Prohibited List;
- attempting to use or using your Player Account through a VPN, proxy or similar services that masks or manipulates the identification of your actual location and/or providing false or misleading information regarding your citizenship, location or place of residence;
- using multiple devices logged into the same account to play Scratch Cards, Bets, or Games simultaneously; and/or
- deliberately or fraudulently registering or attempting to register or otherwise circumventing any self-exclusion and/or GAMSTOP controls; and/or
- seriously breaching the Terms of Use in some other way.
- If we discover or have reason to suspect that you have engaged in any Prohibited Activities, we will have the right to suspend and (ultimately) close your Player Account and, if/as applicable, take the actions set out in section 21 below. We may also refer the matter to the police or any other appropriate regulatory or other authority or person.
- The placement of Bets and Game Wagers and purchase of Scratch Cards is strictly prohibited by any person physically located outside of the Permitted Jurisdictions. We will not accept the placement of Bets, Game Wagers or the purchase of Scratch Cards by persons physically located outside of the Permitted Jurisdictions.
- All information that you provide to us when registering for a Player Account must be true, accurate, complete, up to date and not misleading in all respects. If any of the information you provide to us is untrue, inaccurate, incomplete out of date or misleading, we are entitled to suspend or close your Player Account and treat any Bets and/or Game Wagers and/or Scratch Cards on the Player Account as invalid and any Winnings resulting from such Bets and/or Game Wagers and/or Scratch Cards shall be forfeited. Any other Cash Balance shall be returned to you unless we are required to delay or withhold the payment to you of your Cash Balance (or any part of it) in order to comply with our legal and regulatory obligations including our anti-money laundering and fraud prevention obligations.
- If your Player Account is suspended or closed by us, you should contact us immediately.
- VERIFICATION CHECKS
- We are required to undertake certain checks to comply with our legal and regulatory obligations – for example to verify your age, identity, address, location, financial circumstances, and the source of the funds you deposit and use – and we may also undertake other vulnerability, fraud prevention and verification checks ("Verification Checks"). We may ask you to provide various information and supporting documentation to enable us to carry out these Verification Checks, for example (but without limitation) a copy of your passport, driving licence, birth certificate, proof of address, proof of earnings, and/or bank statements. Until we have received all requested information/documents and completed our Verification Checks to our reasonable satisfaction, we will restrict or place limits on your Player Account in any manner that we reasonably deem appropriate, including by preventing you from accessing the Services, entering into any transactions, or from making withdrawals. If our Verification Checks cannot be completed to our reasonable satisfaction, your Player Account will be suspended and, ultimately, may be permanently closed. In this event, we may also be required by applicable regulation and/or a relevant authority to withhold funds in your Player Account.
- We may use third party providers to confirm your age and identity on our behalf and/or to conduct Verification Checks on you. By registering for a Player Account, you acknowledge and agree: (i) that we may conduct any Verification Checks that we reasonably require, both during Account registration and, if applicable, at any time afterwards; (ii) to promptly provide us with any information we may reasonably need in relation to such Verification Checks; (iii) to promptly provide us with any information we may reasonably need in relation to such Verification Checks; and (iv) that such credit reference and/or fraud prevention agencies may disclose the fact that a search of its records was made in relation to you, to its other customers for the purposes of assessing the risk of giving credit, to prevent fraud and to trace debtors.
- It is your responsibility to keep your registration and Player Account details up to date. Your Player Account information may be amended in the Profile section of the Settings area of the Site. If you require any assistance, please contact us via live chat or email at [email protected].
- You must not use your Player Account as a banking facility and deposits should only be made with a genuine intention to use the Gaming Products (the "Authorised Purpose"). You are not entitled to use your Player Account for any purpose other than the Authorised Purpose. If we reasonably believe that you are using your Player Account for any purpose other than the Authorised Purpose, we may suspend your Player Account to investigate further. We are entitled to close your Player Account as a result of such investigation and report any suspicious misuse to the relevant authorities. In addition, we shall be entitled to withhold and/or retain any and all amounts accrued by you as a result of or in connection with your unauthorised use of the Site including activities which are not for the Authorised Purpose.

YOUR PLAYER ACCOUNT
- To use our Site and Gaming Products you must register as a Player and create a Player Account. You can register by clicking the "Sign up" button found within the main menu of the Site. We are entitled to refuse to register, or create a Player Account for, any person.
- Upon registration you will be prompted to choose an email and password combination that will become your authentication criteria to login to Lottomart, access your Player Account and place Bets and/or Game Wager and/or purchase Scratch Cards. You must keep this information secret and confidential as you are responsible for all Bets and/or Game Wagers placed, Scratch Cards purchased and any other activities, transactions and purchases made through your Player Account.
- You may change any contact details or other information associated with your Player Account at any time by contacting our customer support team via live chat or email at [email protected]. It is your responsibility to ensure that you update any contact details or other information on your Player Account if it becomes out of date, incorrect or inaccurate.
- Your log in persists between your sessions on the Site. You can disable this feature by selecting "Require password" within the General section of the Settings area on the Site. Even when "Require password" is selected it is possible that other authentication management tools/services on your device (Keychain, 1Password, etc) automatically populate the authentication criteria and therefore enable access to your Player Account. It is therefore important that you protect the security of the device(s) that you use to access the Site as you are fully responsible for any activity, transactions and purchases made through your Player Account resulting from a valid authentication.
- Bets and/or Game Wagers placed and purchases made through your Player Account will be valid if your email and password have been entered correctly or resulting from a persisted login (whether or not authorised by you) subject to there being a confirmed payment transaction against your Player Account.
- If at any time, you think a third party is or may be aware of your email and password combination you should change it immediately via the Settings section of your Player Account. If you think that someone else may know your username and password please notify us by email to [email protected], chat or phone immediately so that we can block access to your Player Account and/or arrange for your username and password to be changed. You are responsible and liable for all activities, transactions and purchases made through your Player Account resulting from a valid log-in or authentication.
- To place a Bet or Game Wager or purchase a Scratch Card you are first required to link a Payment Card to your Player Account or set up a Payment Method to transfer funds to your Player Account.
- Please note that cardholder details, card details, and any other sensitive data should never be sent to us via unencrypted email.
- If your Payment Card is lost, blocked, stolen or expires or if the access credentials to your Payment Method are in any way compromised, you must notify us immediately so that we can place a block on use of that Payment Card on our Site and update your details accordingly. If you do not notify us immediately, we will assume that any Bets and/or Game Wager placed or Scratch Cards purchased have been authorised by you and you shall be responsible and liable for all activities, transactions and purchases made through your Player Account.
- You are only permitted to have one Player Account at any time. If you open more than one Player Account and/or the same payment details are used in respect of multiple Player Accounts (each such additional Player Account being a "Duplicate Player Account"), we will be entitled, in respect of each Duplicate Account, to: (i) close such duplicate Player Account/s without notice, leaving you with only the original Player Account (unless we have reason – for example if you have deliberately or fraudulently opened more than one active Player Account – to close all your Player Accounts); (ii) void any Bets and/or Game Wagers placed (including Free Spins), or Scratch Cards purchased, through such Duplicate Player Account and any Winnings associated with or accrued from such Bets, Game Wagers or Scratch Card purchases; and treat all promotions and/or bonuses using the Duplicate Player Account, and all Winnings accrued from such promotions and/or bonuses promotions and/or bonuses, as void.
- A Player Account is personal to the individual who has registered the account. You are not permitted to grant any third-party access to your Player Account and you are not permitted to use the Player Account of any third party. If a third party uses your Player Account, we may suspend or terminate your Player Account without notice to you and any Bets and/or Game Wagers placed (including Free Spins), or Scratch Cards purchased through the relevant Player Account will be void and any Winnings associated with such Bets, Game Wagers or Scratch Cards will be forfeited.
- You may terminate the Terms of Use and close your Player Account with us at any time by following the account closure procedure available on the Settings section of our Site or by contacting Customer Support at [email protected]. You may also 'time out' your Player Account, or "self-exclude" yourself from using your Player Account in accordance with the procedure set out in our Safer Gambling Policy accessible on the Site or as summarised in the Safer Gambling section at Section 9 below.
- We comply with the applicable data protection laws (including, in the UK, the Data Protection Act 2018 and General Data Protection Regulation 2016 and in Gibraltar, the Data Protection Act 2004) in respect of the personal information you supply to us. Your personal information is processed in accordance with our Privacy Policy.
- Depending on your location and/or account address, certain Scratch Cards, Lottery Bets, Games, and/or bundles or features of those the aforementioned products may not be available to you.

DORMANT PLAYER ACCOUNTS
- Your Player Account will be categorised as "dormant" if you have not performed at least one of the following actions during any continuous period of twelve (12) months:
- a valid deposit is made into your Player Account;
- a valid withdrawal is made from your Player Account;
- any Bet, Game Wager, use of Diamonds, or any other purchase is made from your Player Account.
- If your Player Account is categorised as dormant, we will:
- attempt to refund any remaining Cash Balance to any Payment Methods associated to your Player Account, subject always to compliance with any applicable regulatory or legal requirements. If no valid Payment Method exists or if it isn't possible to refund to your associated Payment Methods and/or the refund request is unsuccessful, the Cash Balance will remain in your Player Account and we will use reasonable efforts to notify you that we have not been able to refund your Cash Balance;
- void any pending Game Wagers and return and return any cash used to place the wagers to your Cash Balance;
- void any un-scratched and active Scratch Cards and return any cash used to purchase them (if applicable), to your Cash Balance;
- void any unused and active Free Spins and return any cash used to purchase them (if applicable) to your Cash Balance;
- expire any active or pending Bonuses and set your Bonus Balance to zero;
- expire and remove any Diamonds credited to, or accrued on, your Player Account; and
- reset your diamond status to the starting tier.
- If your Player Account remains dormant by the first day of the calendar month subsequent to the month in which it was categorised as dormant, we will start charging a monthly Administrative Fee of the greater of 2% of your Cash Balance or £1 (or applicable currency equivalent) for so long as your Player Account remains dormant. If the Cash Balance on your Player Account is less than £1, we will reduce the Cash Balance to zero. If the Cash Balance on your Player Account is £0, no fee will be applied.
- In order to give you an opportunity to access your funds prior to any action taken as per 8.2, we shall use reasonable efforts to contact you not less than thirty (30) days prior to your Player Account being categorised as dormant, to remind you that your Player Account is due to be classified as dormant. In doing so, we will advise you of any Cash Balance in your Player Account and the fees and actions that will be applied if your Player Account does become dormant.
- You can reactivate your dormant Player Account at any time by performing any action as defined at Section 8.1.
- If at any time you contact us to seek a refund of any Administration Fees we have deducted from your Player Account, we shall process such refund, subject to your compliance with these Terms of Use and our legal and regulatory obligations.
- Your Player Account will be categorised as "dormant" if you have not performed at least one of the following actions during any continuous period of twelve (12) months:

PAYMENTS MADE TO US
- We accept payment for Bets and Game Wagers and for the purchase of Scratch Cards via our Site by Payment Card and other accepted Payment Methods from time to time. We do not accept corporate or business credit or debit cards as a method of payment. If we detect that you have attempted to use, or successfully used a corporate or business credit or debit card, we may suspend your Player Account and any Winnings in respect of any Bets or Game Wagers or Scratch Cards paid for using such card(s) shall be void and we shall not be liable to pay any such Winnings to you.
- Payment may be made to us in such currencies as we may from time to time accept. Payments made in cash or by cheque will not be accepted.
- On receipt by us of payment in cleared funds in respect of any Bet or Game Wagers or Scratch Card, those funds will be committed to the corresponding Bet(s) or Scratch Card(s) or to the balance of your Player Account. Balances held to the credit of a Player Account do not accrue interest.
- We may request proof from you that you have authority to use any Payment Card or your selected Payment Method which you have sought to link, or linked, to your Player Account. You must only make payments to us from bank accounts where you are the sole (or jointly) named account holder. In cases where we identify that you are not the sole (or jointly) named account holder or the named account holder differs from the name associated with your Player Account, we are entitled to suspend or restrict your Player Account, to investigate the matter, to make any necessary notifications to the relevant authorities and to temporarily or permanently withhold the return to you of your Cash Balance. In such circumstances, we may treat any transactions that have been made on your Player Account from the relevant bank account as being invalid (and any Winnings from such transactions shall be forfeited).
- You may make a pre-payment to us for a number of Bets in relation to a set number of future draws relating to a specific Underlying Lottery at the price advertised for the next draw that will occur in relation to the relevant Underlying Lottery. You will not be able to cancel any Bets that you have paid for in advance and you will not be entitled to any refund, save for in accordance with the Terms of Use. If we cancel any Bets that you have paid for in advance, we will refund the amount paid to us in respect of the relevant Bet(s) to you.
- You must not attempt to chargeback or otherwise reverse any payments made to us. Notwithstanding any other term in the Terms of Use, if we discover that any funds used to place a Bet or purchase a Scratch Card are subject to any chargeback or other reversal we shall be entitled to void any related Bets, Free Spins, Game Wagers and/or Scratch Cards and we may withhold or delay the payment of, or forfeit any, Winnings associated with such Bets, Free Spins, Game Wagers or Scratch Cards.
- Bets and Game Wagers will not be valid and the purchase of any Scratch Cards shall not be approved if there are insufficient funds in your bank account or an attempt by us to collect payment in respect of any Bet against your designated Payment Card or Payment Method fails for any reason or there is any chargeback or other reversal in respect of any payment. We shall not pay any Winnings to you in respect of any Bets, Game Wagers or Scratch Cards, payment for which has not been received in full. We may charge you for any fees or penalties that we suffer as a direct result of any chargeback or other reversal in respect of any payment.
- Customer funds are kept in accounts separate from the business accounts. These accounts may include bank accounts, investment accounts and other accounts. These funds are not protected in the event of insolvency: not protected segregation. In the event of insolvency of Lottomart, you may lose any Cash Balance. DIAMOND CLUB
- When you create a Player Account, you will be automatically enrolled in the Diamond Club, earning Diamonds for each eligible purchase and Game Wager you make through the Site.
- You will not earn Diamonds if you are redeeming Diamonds to pay for a purchase.
- Certain promotions may not earn you Diamonds. Please refer to promotion-specific terms and conditions for details.
- The number of Diamonds that you will earn in respect of each purchase or Game Wager will be displayed in your purchase summary.
- The more Diamonds you collect, the higher your Player Account Diamond Club status will be. There are 5 tiers: Club, Bronze, Silver, Gold, and Platinum. Your Player Account will have 'Club' status when your Player Account is opened.
- Once you have earned enough Diamonds to achieve a Diamond tier level beyond Club (for example, Bronze, Silver, Gold or Platinum) your Player Account Diamond Club status will not be reduced and there are no ongoing requirements to maintain that status provided that your Player Account is not deemed to be dormant in accordance with Section 8.
- You can check your Diamond balance, the Diamond status of Your Player Account and your progress to the next tier in the Diamond status in the 'My Account' area of the Site.
- You may only use the Diamonds earned on your Player Account to pay for Bets, Scratch Cards, bundles, or top ups. Diamonds will appear as a payment option, provided that you have sufficient Diamonds in your Diamonds balance to cover the entire cost of the purchase(s).
- Diamonds cannot be used to place any Game Wager.
- The number of Diamonds you may accumulate (if any) is currency, game and status dependent and may be subject to change at any time. You can check these values in the Diamond Club area of the Site.
- A Diamond equivalent cash value when applied towards a purchase is currency dependent and may be subject to change at any time. You can check this value in the Diamond Club area of the Site.
- Diamonds cannot be withdrawn.
- All the Diamonds earned on your Player Account will expire if you do not make a successful deposit, withdrawal, Bet, Game Wager, or Diamonds transaction through your Player Account for a continuous period of 90 days.
- Diamonds cannot be transferred to another Player or Player Account and cannot otherwise be transferred.
- We are entitled to cancel and withdraw the Diamond Club at any time without notice to you. Upon cancellation and withdrawal of the Diamond Club, all Diamonds credited to your Player Account shall no longer be valid and shall be removed. You shall not be entitled to receive any equivalent cash value in respect of cancelled Diamonds.

WITHDRAWALS
- You may withdraw all or some of your Cash Balance at any time, provided that:
- all the payments made to us in respect of the relevant Bet(s) or Game Wager(s) or Scratch Card(s) have been confirmed as cleared and have not been charged-back, reversed or otherwise cancelled;
- the name on your Payment Card or other Payment Method matches the name appearing on your Player Account;
- we have completed our Verification Checks to our reasonable satisfaction (where we have requested information from you to carry out these Verification Checks, any delay in providing this information may cause delay when withdrawing funds);
- there is no other reason why we are required to delay or withhold the payment to you of your Cash Balance (or any part of it) in order to comply with our legal or regulatory obligations;
- there are no withdrawal limits imposed by the provider of your Payment Card or Payment Method which would restrict us from completing the withdrawal request;
- there are not any active or pending bonuses on your Player Account which, subject to the relevant Promotional Terms, restrict your right to withdraw any amounts until the applicable conditions are satisfied; and
- there is currently no ongoing, or completed (save where completed and decided in your favour), investigation: (i) into an Error, Interruption or Malfunction involving any aspect of the Services which you have used; or (ii) where we have reasonable grounds to believe you have engaged in a Prohibited Activity which would entitle us to withhold funds in accordance with section 21.4, and in the case of (a) and (b) above, you acknowledge and understand that, as we made clear in the "Important Information" section at the beginning of these Terms and Conditions, we are ultimately entitled to void any affected transactions, withhold funds (including any Winnings) and (in the case of illegal or Prohibited Activities) suspend and, ultimately, close your Player Account.
- If you would like to request to withdraw any of your Cash Balance, you may do so at any time by clicking on the "Withdraw" button on the Site via your Player Account. You will not be able to reverse a request to make a withdrawal from your Player Account. Please note that withdrawals are returned to the original Payment Card or Payment Method you used to deposit in a "closed loop" manner. If you have used multiple Payment Cards and/or Payment Methods to deposit funds, we may need to request additional information, background, and documentation regarding your payment patterns, adjust the withdrawal proportions to match your deposit ratios, and take any other measures we consider necessary to satisfy security and prevention of money laundering policies.
- If you want to withdraw less than the minimum withdrawal amount, we may charge a fee for processing the withdrawal (such fee shall not exceed a reasonable estimate of the costs incurred by us in relation to the processing of the withdrawal). The minimum withdrawal limit will not apply if you are closing your Player Account.
- We will not be liable to you if we cannot pay your Cash Balance to you due to the information provided to us by you being incorrect, incomplete or invalid.
- Even though Prizes may be advertised or referred to in certain currencies within the Terms of Use or on the Site, Lottomart is entitled to pay Winnings to you (at its sole option) in any currency that it may from time to time determine. As indicated in section 17.9 of the Supplemental Game Terms, Winnings will be calculated and credited to us in EUR. Winnings may also be credited to us by other Hedging Partners in a currency that is different to the currency in which we actually pay the Winnings to you. You acknowledge and agree that you shall bear the cost of (i) any Winnings being converted from the currency in which the related Prize was advertised or referred to on the Site into the currency in which those Winnings are paid or credited to us; and (ii) the cost of any Winnings being converted by us (if applicable) into the currency in which those Winnings are actually paid to you, in each case including any exchange rate or bank charges imposed on the conversion(s).
- For security reasons and for the prevention of money laundering, we may in limited circumstances authorise a withdrawal of your Cash Balance to a bank account held in your name. If you provide account details to us which relate to a bank account held jointly between you and another person, you accept that your Cash Balance may be paid into that joint account and payment by us to such joint account shall absolutely discharge us from our payment obligation to you. Before we can make any payment to a joint bank account you accept that Lottomart may require you to supply additional documentation relating to the person jointly holding the bank account so that Lottomart may identify and verify the identity of the joint account holder.
- In limited circumstances, Lottomart may agree to pay your Cash Balance to a bank account held in your name and only after we receive, following a request by us, the following information:
- Proof of personal identification documents including copies of a valid identification document or other means of verification matching the name, date of birth and residential address associated with your Player Account;
- Proof of ownership by you of the bank account into which your Cash Balance is to be paid and evidence that the Payment Card or Payment Method linked to your Player Account is the same as your name appearing on your Player Account (this may involve us asking you to provide us with a copy or picture of the front and back of your Payment Card showing the last four digits of the long card number only and with the CVV code on the back of the card blocked out);
- Instructions from you confirming the details of the bank account that you request the funds to be transferred to; and
- Such other documentation and/or consents that Lottomart may reasonably require in order to effect or secure the payment of your Cash Balance to you (including documents and data as may be required by any Hedging Partner).
- We may charge a fee for processing a bank transfer withdrawal (such fee shall not exceed a reasonable estimate of the costs incurred by us in relation to the processing of the withdrawal).
- Where any Prizes in respect of a Bet are awarded on a "for life" or annuity basis we are entitled to verify or appoint a third party to verify that you are still alive. Prizes awarded on a "for life" or annuity basis are personal and will not benefit your personal representatives or successors in title.
- If, regardless of us requesting such documents from you, you fail to supply any of the information or documents set out in section 13.7 above within a period of 30 days after announcement of the winning numbers, you will not be entitled to claim any Winnings and we shall have no obligation to pay any Winnings to you in respect of the relevant Bets.
- You may opt to receive notifications via email, SMS and/or "push" notifications informing you of the results of any of your Bets.
- We may from time to time purchase actual lottery ticket entries for the Underlying Lottery draws on your behalf which mirror the Bet(s) you have placed. In the event that any Winnings are payable to you in relation to any Bets you have placed, you agree that we may require you to claim such Winnings directly from the relevant Underlying Lottery Operator using the actual lottery ticket entry that we purchased on your behalf and in the event that such Winnings incur any taxes, duties or levies, these are to be borne by you. Payment by the relevant Underlying Lottery Operator to you of the Winnings that would otherwise have been payable to you by us will discharge us in full from any liability to pay any Winnings to you in respect of the relevant Bet(s). In the event that the relevant Underlying Lottery Operator fails or refuses to pay some or all of the Winnings to you, we will refund any stakes paid to us and we shall not be liable to pay any Winnings to you in respect of the relevant Bet(s).
- Any Winnings credited to your Player Account will be visible in your Cash Balance and/or active Bonus Balance after the results of the relevant lottery draw(s) have been published on the Site and/or after the outcome of the relevant Game Wager and/or Scratch Card has been determined. You may use any Winnings to place further Bets or Game Wagers, or to purchase Scratch Cards or request a withdrawal in accordance with these Terms and Conditions.
- If any funds are credited to your Player Account in error, we are entitled to remove and/or recover such funds and void any transactions involving such funds, either at that time or retrospectively.
- You are solely responsible (as applicable) for any bank charges or tax obligations (including, but not limited to potential VAT, gambling or betting tax/duty, corporation taxation, turnover taxation, yield taxation and income tax), duties or levies accruing on Bets placed with us and for any Winnings paid by us to you or by any relevant Underlying Lottery Operator.
- You may withdraw all or some of your Cash Balance at any time, provided that:

PLACING BETS ON THE OUTCOME OF LOTTERIES
- Lottomart is not a lottery operator. By completing and purchasing a Bet Ticket with Lottomart you are betting on the outcome (results) of the drawing of an official and/or state-run lottery.
- Lottomart is entitled to decline all, or part, of any Bet requested by you at its sole and absolute discretion. We are entitled to suspend or cease the acceptance of Bets in respect of any Underlying Lottery at any time. All Bets are placed at your own risk and discretion.
- Bets may only be made online via the Site. Bets may not be made in any other form (post, phone, email, etc.) and if payment is received otherwise than online via the Site the related Bets will be invalid and void.
- It is your responsibility to ensure that the details of your Bet are correct. Once Bets have been placed they cannot not be cancelled or changed by you.
- We are entitled to cancel a Bet at any time before: the Underlying Lottery draw actually takes place; or, if earlier, the Bet (and each Line Bet) achieves 'in-play' status as evidenced by the operating systems used by us. We will refund any stake paid to us in respect of any such cancelled Bet and we shall not be liable to pay you any Winnings in respect of any such cancelled Bet. Any other Gaming Products on your Bet Ticket will not be affected by the cancellation of any Bet (unless specifically notified by us to you through your Player Account).
- Upon requesting to place a Bet or making any pre-payment to us for a number of Bets in relation to a set number of draws relating to a specific Underlying Lottery you will receive an order confirmation message within the Site, a confirmation email, and the Bet Ticket will appear in the My Buys section of the Site. The status of each Bet (each Line Bet) will be displayed as 'pending'. These notifications are confirmation of your request to place the relevant Bets and do not constitute acceptance by us of your Bet. A Bet (and each Line Bet) is only accepted by us when the Bet (and each Line Bet) achieves 'in-play' status as evidenced by the operating systems used by us.
- In the event that we do not accept a Bet (and its status (and the status of the relevant Line Bet(s)) does not change to 'in-play') the stake corresponding to that Bet shall be refunded to your Player Account, the relevant Bet shall be invalid and we shall not be required to pay any Winnings to you in respect of the relevant Bets.
- Notwithstanding the above, Bets placed via Payment Card or any Payment Method are not valid until we have received payment in full. In the event that we do not receive payment in full prior to the relevant Underlying Lottery draw commencing or there is any chargeback or other reversal in respect of the payment your Bet will be void (even if the status of the Bet was 'in-play') and we shall not be required to pay any Winnings to you in respect of the relevant Bets.
- To request to place a Bet you must complete a Bet Ticket by selecting the lottery draw(s) that you want to bet on the outcome of and by choosing your Line Bets for the draw.
- A Bet Ticket can contain multiple Line Bets for a specific draw.
- You may elect to Boost your Bet Ticket to increase your chances of winning a Prize. Refer to Boost terms and conditions in section 15.
- The deadline for requesting to place a Bet on an Underlying Lottery draw is determined for each respective draw and will be posted on the Site. You are responsible for ensuring that your Bet request is made and received by us (as evidenced by the notification sent to you under section 14.6 above) prior to the relevant draw deadline. For the avoidance of doubt, instructions to place or the apparent placement of a Bet after the start of a specific draw or draw that has already occurred will not be valid, irrespective of any automatic confirmation that may be generated via email or message within the Site, or irrespective of any incorrect deadline displayed on the Site and no Winnings shall be payable in respect of any such Bet.
- If a Bet is mistakenly accepted after the relevant deadline or after the start of the relevant underlying lottery draw or we become aware of a genuine error in relation to a Bet and we are not able to contact you to correct the error or confirm the Bet before the deadline, we are entitled to cancel such Bets, refund the relevant stakes to you and no Winnings shall be payable by us to you in respect of those Bets.
- If you request to place a Bet on an Underlying Lottery draw that does not take place or if no draw result is published or officially announced in respect of any Underlying Lottery draw, all Bets placed on that draw will stand for any draw rescheduled by the Underlying Lottery Operator or, if there is no rescheduled draw, Lottomart shall (at its sole discretion) place the Bet on the next available draw of the relevant Underlying Lottery or refund the stakes in relation to the Bet(s) to your Player Account.
- We try our best to make sure that the information available on our Site is correct. We shall not be liable for any mistakes, errors or out of date, incomplete or incorrect information appearing on the Site including (without limitation) details of any estimated jackpots in relation to any lottery draw which may be incorrect for any reason, including (without limitation) any unforeseen rollover. We make no representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete or up to date. Lottomart may estimate the amount of future jackpots using certain assumptions, such as the current or future jackpot being won or rolled over, but is not liable for false assumptions, calculations or forecasts.
- Lottomart shall have no liability for errors which are discovered only after Winnings have been paid to you including (without limitation) where the error is based on incorrect information published by the Underlying Lottery Operator or on websites relevant to the Prizes or Winnings.
- We shall not be liable for any errors in, or delays to, any alert or push notification that we send you and we do not guarantee that any such alerts or push notifications will be received by you or provided to you in advance of the deadline beyond which we will no longer accept any Bets in connection with a particular Underlying Lottery draw.
- We may terminate or suspend the acceptance of Bets on any Underlying Lottery/ies at any time. If we terminate or suspend the acceptance of Bets on any Underlying Lottery/ies, we are entitled to cancel any relevant Bets that do not yet show as having an 'in play' status in your Player Account. If we cancel any such Bets, we will refund the stake(s) paid by you to us in respect of such Bet(s) and no Winnings shall be payable by us to you in respect of those Bets.
- If any of our Hedging Partners suspend or terminate the services provided by them to us for any reason, we are entitled to cancel any relevant Bets that do not yet show as having an 'in play' status in your Player Account. If we cancel any such Bets, we will refund the stake(s) paid by you to us in respect of such Bet(s) and no Winnings shall be payable by us to you in respect of those Bets.
- If Winnings are payable to you, you consent to us sharing your personal data with any relevant Hedging Partner for the purposes of verifying your identity. We may transfer your personal data to our Hedging Partners outside the EEA or the country in which we or you are located in line with our Privacy Policy.

CHANCE BOOST IN RELATION TO BETS ON THE OUTCOME OF LOTTERIES
- To increase the chances of your Bet Ticket including a winning Bet (or Line Bet) you can request to multiply the number of Line Bets on your Bet Ticket at no additional cost by activating the Boost feature (if available) when configuring your Bet Ticket. Boosting your Bet Ticket does not change the odds of winning a Prize on any individual Line Bet.
- For each additional Line Bet added as a result of the Boost, a combination of numbers will be randomly generated to create each additional Line Bet and the amount of the stake placed by you in respect of each Line Bet and the maximum amount of Winnings (in every Prize Category including the Jackpot Prize Category) that you will be eligible to receive if any of your Line Bets are successful will reduce linearly. When a Bet Ticket is Boosted all Prize Categories in respect of which the Bet has been placed are proportionately adjusted so that all of the Prizes you can win (including the Jackpot Prize Category) are reduced by the same factor as the Boost selected in respect of all the Line Bets in the Bet Ticket.

- For Bet Ticket Pre-Orders, if you have requested to Boost the Bet Ticket Pre-Order, the availability of the Boost in respect of the relevant Bet(s) will be subject to confirmation at the time the future draw is actually opened, once the Jackpot details have been confirmed, and the availability of the Boost option in respect of the relevant Bet(s) for the specific draw have been verified by the operating systems used by us.
- In the event that you have requested to Boost a Bet Ticket Pre-Order, and the Boost is not supported (and the availability of the Boost option in respect of the relevant Bet(s) is not confirmed or verified by the operating systems used by us) in relation to any specific Underlying Lottery draw, the Boost configuration for the affected Line Bets will be declined and the Bet Ticket will be processed as though the Boost had not been requested. If the Bet Ticket Pre-Order relates to further future draws, the process outlined in sections 15.6 and 15.7 will be repeated for each Underlying Lottery draw.

IMPORTANT TERMS RELATING TO WINNINGS IN RESPECT OF BETS ON THE OUTCOME OF LOTTERIES
- We may from time to time maintain insurance policies and/or other arrangements pursuant to which we receive cover for any liability to pay Winnings. We have entered into an arrangement with EU Lotto pursuant to which each time you place a Bet with us, we may place a reciprocal bet with EU Lotto. This provides us with cover in event that your Bet wins the top Prize Tier/Jackpot/Prize Category 1 or any secondary Prize Tier. In relation to any Winnings in a Type C Prize Category, if we have placed a reciprocal bet with EU Lotto, section 17.6 (Winnings in a Type C Prize Category) will apply and if we have not placed a reciprocal bet with EU Lotto, section 16.2 below will apply instead.
- Winnings in a Type C Prize Category. Unless the Game Overview says that Winnings are paid out as published on the Operator's Website and/or we have published Prizes on our Site (in which case the Prize published on our Site shall apply and the Winnings shall be independent of the Prize or Winnings published or announced by the Underlying Lottery Operator), the Winnings to be paid out in respect of each winning Bet in a Type C Prize Category (as defined in section 17 below, for example Prize Category 4 in EuroMillions) shall be the amount of the Prize announced by the Underlying Lottery Operator in respect of an Underlying Lottery winning ticket in the respective Prize Category. If the Underlying Lottery Operator has not announced a Prize in the respective Prize Category for the relevant draw of the Underlying Lottery, the Winnings payable in respect of each winning Bet in that Prize Category will be calculated on the basis of the aggregate amounts paid in for the relevant draw of the Underlying Lottery announced by the Underlying Lottery Operator and its allocation to the winning Prize Categories.
- References to "EU Lotto" in the Game Overview in section 17.3 and in the definitions of "Jackpot" and "Underlying Lottery" in section 17 are to be read as references to "Lottomart".
- Winnings will be calculated by us or by EU Lotto in accordance with any Pay Table displayed on our Site in connection with the relevant Underlying Lottery draw and these Terms and Conditions (including, in particular, the Supplemental Game Terms). In the event there is any conflict or inconsistency between the Pay Table, Supplemental Game Terms and/or these Terms and Conditions, the order of priority will be (i) the Supplemental Game Terms, (ii) these Terms and Conditions and (iii) the Pay Table.
- Notwithstanding any other term in the Terms of Use, in the event that your Bet wins the top Prize Tier/Jackpot/Prize Category 1 or secondary Prize Tier, we will not be liable to you and we will not be required to pay such Winnings to you unless and until we receive such Winnings from EU Lotto or any other relevant Hedging Partner. You acknowledge and agree that we will only be liable to you for any top Prize Tier/Jackpot/Prize Category 1 or secondary Prize Tier Winnings to the extent that we have actually received such Winnings from EU Lotto or any other relevant Hedging Partner. If, for any reason EU Lotto or any other relevant Hedging Partner fails to pay such Winnings to us, our liability to you in respect of the winning Bet and the associated top Prize Tier/Jackpot/Prize Category 1 or secondary Prize Tier will be limited to £250,000 (or applicable currency equivalent).
- We will only pay Winnings to you if you have complied with the Terms of Use and, in the event that your Bet wins the top Prize Tier/Jackpot/Prize Category 1 or secondary Prize Tier, as soon as reasonably practicable after we actually receive the corresponding Winnings from EU Lotto or any other relevant Hedging Partner.
- The rules applicable to certain Underlying Lotteries state that there will be a maximum cap on the amount that the jackpot can grow to. If the jackpot in the relevant Underlying Lottery exceeds the cap, the rules of certain of the Underlying Lotteries state that the amount in excess of the cap will be added to the prize pool for the secondary Prize Category(ies). The rules of certain of the Underlying Lotteries similarly state that there will be payments from one Prize Category to another Prize Category if there are no winning tickets in a Prize Category in connection with a specific draw or if there are no winning tickets in a Prize Category for a number of subsequent draws. Please note that Lottomart does not acknowledge or take account of any such 'rolldown' or payment of prizes from one Prize Category to another Prize Category and if you have a winning Bet, the Winnings payable to you will be calculated in accordance with the Terms of Use and based only on what prizes would have been paid if there had been no addition of funds from another Prize Category into the Prize Category that you have won.
- Prizes in a Type A Prize Category and a Type B Prize Category (as defined in section 17 below) are commonly referred to as pari mutuel prizes. Prizes in a Type C Prize Category (as defined in section 17 below) are commonly referred to as non-shared prizes.
- ADJUSTMENTS
- The amount payable to you in respect of a winning Bet may be divided by the total number of official winners of the Underlying Lottery and EU Lotto Winning Bets (see the Supplemental Game Terms in section 17 for more information).
- The amount payable to you in respect of a winning Bet for certain lottery draws is also subject to the same adjustments and deductions (for tax, withholdings or otherwise) that would be applied if you had purchased a winning ticket in the Underlying Lottery. The amount of the adjustments or deductions will depend on which Underlying Lottery you have placed a Bet on the outcome of. In some instances, these adjustments and deductions can result in a reduction of up to 38% (see the Supplemental Game Terms applicable to Bets on the outcome of lotteries in section 17 for more information).
- In addition to the adjustments and deductions that shall be applied in accordance with the Supplemental Game Terms in section 17, Winnings for certain lottery draws may be paid out to you over a number of years (in some instances up to 30 years, which is referred to as an "Annuity Payment Option") or as a discounted lump sum at Lottomart's election (see the Supplemental Game Terms in section 17 for more information).
- The impact of the adjustments outlined in sections 16.9.1, 16.9.2 and 16.9.3 above is that in some cases the net Winnings actually paid to you by us might be less than half the estimated top Prize Tier/Jackpot/Prize Category 1 or other Prize advertised on the Site.

Here are some examples of how these adjustments impact on the amount of Winnings:
a) If you place a winning Bet on the MUSL Mega Millions or Powerball draws and win The top Prize Tier/Jackpot/Prize Category 1: (a) the total Prize in respect of the winning Bet will be divided by the total number of official winners of the Underlying Lottery and EU Lotto Winning Bets; (b) deductions for withholdings of 38% will be applied to the divided amount so that you are put in a similar economic position as if you had purchased a winning ticket in the Underlying Lottery; and (c) Lottomart may, at its sole discretion, elect to pay the Winnings to you over a 30-year period (the "Annuity Payment Option") or in one discounted lump sum (the "Lump Sum Option"). If Lottomart chooses the Annuity Payment Option, the first payment will be made to you as soon as reasonably practicable after we actually receive the corresponding Winnings from the relevant Hedging Partner (and subject to these Terms and Conditions), and the next 29 payments will be made at one-year intervals after the date of the first payment. The amount of each payment will increase by the percentage set by the Multi-State Lottery Association (MUSL) from year to year until the full amount of Winnings has been paid to you. If Lottomart chooses the Lump Sum Option, the amount payable to you will be further reduced by the relevant discount rate, as determined by the Underlying Lottery (as would be the case if you had purchased a winning ticket in the Underlying Lottery). The result is that the Lump Sum Option is equal to, at most, 60% of the Annuity Payment Option value, but will vary depending on the final jackpot amount and the final discount rate set by the Underlying Lottery.
b) If you place a winning Bet on the MUSL Mega Millions or Powerball draws and win the second Prize Tier, deductions for withholdings of 38% will be applied so that you are put in a similar economic position as if you had purchased a winning ticket in the Underlying Lottery.
c) If you place a winning Bet on SuperEnalotto and win the top Prize Tier/Jackpot/Prize Category 1 or second Prize Tier: (a) the total Prize will be divided by the total number of official winners of the Underlying Lottery and EU Lotto Winning Bets; and (b) deductions of 20% will be made to the divided amount so that you are put in a similar economic position as if you had purchased a winning ticket in the Underlying Lottery.
- If a Pay Table shows that a prize is a "Type C (special)" prize, this means that the prize is not shared and is the same for every winning combination unless the total amount of Type C (special) Winnings won in relation to all EU Lotto Winning Bets exceed the cap stated in the Pay Table. In that case, the winnings you receive will be divided between the winners so that the total amount of Type C (special) winnings paid out does not exceed the cap.
- ADJUSTMENTS. If a winning Bet was purchased on a Boosted Bet Ticket then the amount of Winnings payable to you will also be subject to the applicable adjustment in accordance with section 15 above (Chance Boost in Relation to Bets on the Outcome of Lotteries).
- CIRCUMSTANCES IN WHICH BETS MAY BE VOID AND WINNINGS MAY NOT BE PAID - We may void any Bets and any Winnings from the relevant Bets will be forfeited if:
- the Underlying Lottery draw has been declared invalid by the Underlying Lottery Operator; or
- there has been a manifest error, mistake or system failure that resulted in in the terms on which the Bet was offered to you being materially incorrect, and in each of these instances, we will return the stakes paid by you to us in respect of such Bets to your Player Account.
- It is your responsibility to ensure that all steps necessary or desirable to enable us to pay you on for you to receive any Winnings (including, without limitation, the opening of any bank account or the implementation of any other facilities required to receive the Winnings) are taken promptly and without delay. If for any reason whatsoever we have been unable to pay the entirety of any Winnings to you (in the event that your Bet wins the top Prize Tier/Jackpot/Prize Category 1), or such amount has not been accepted by you within a reasonable period of time (not to exceed 30 days commencing from the day we receive such Jackpot Winnings from EU Lotto or any other relevant Hedging Partner) then we shall have no further liability to pay such Winnings to you and such Winnings shall be forfeited by you.
- The calculation by us or our Hedging Partners (acting reasonably) of the amount of Winnings actually payable to you shall be conclusive and our payment to you of any Winnings shall discharge us from our payment obligation to you.
- We shall not be liable to pay any Winnings to you if:
- the Bet was placed by mistake or accepted by us after the Bet deadline or if the relevant Underlying Lottery draw had already begun or taken place at the time the Bet status was mistakenly changed to 'in play';
- you do not legitimately hold a Player Account;
- you have been involved in any fraud-related activity in relation to either the placing of the Bet, the operation of your Player Account or otherwise in connection with the Site or the services available through it;
- you are less than 18 years old or under the age at which it is lawful for you to use our Site and services in the place in which you are situated, or you are an employee (or the spouse or dependent of an employee) of Lottomart or EU Lotto;
- in conjunction with any Underlying Lottery draw, fraud, technical and/or human error or unwarranted influence was found by the Underlying Lottery Operator;
- the Underlying Lottery draw is declared publicly by an Underlying Lottery Operator to be invalid; and/or
- there is a valid issue that has been identified by us or any relevant Hedging Partner (acting reasonably) that remains unresolved in relation to the verification tasks detailed in section 17.2 below and/or you have not been identified to the reasonable satisfaction of any relevant Hedging Partner.
- In the unlikely event that Winnings are not, in fact, Winnings, due to an event or circumstances that was not known to us or our Hedging Partners at the time our Hedging Partners paid those Winnings to us, you acknowledge and agree that we may deduct such Winnings from your Player Account, or, if such Winnings have already been paid to you, you shall return such Winnings to us, we shall refund the stake received by us in respect of the relevant Bet and we shall have no further liability to pay any Winnings to you in connection with the relevant Bet.
- If there is any dispute between us and any Hedging Partner, you acknowledge and accept that this may result in a delay in the payment of any Winnings to you.

SUPPLEMENTAL GAME TERMS
- CONDITIONS OF USE
- Each Player must:
- be 18 years of age or over;
- pay any taxes due on Winnings;
- not be a person on the Excluded List;
- at the time of placing a Bet not be (a) a director, officer, employee (or the spouse or dependant of any of the foregoing) of EU Lotto or of any of the EU Lotto Group companies; or (b) a person which EU Lotto believes to be in a position to manipulate the outcome of a Bet;
- acknowledge that instructions to place or the apparent placement of a Bet after the submission deadline and/or after the start of a specific draw or a draw that has actually occurred will not be valid, irrespective of any automatic confirmation that may be generated or irrespective of a wrong deadline displayed on the Operator's Website;
- acknowledge that the jackpot values displayed for lotteries offered on the Operator's Website are approximate estimates of what the jackpot will be using certain assumptions, such as the current or future jackpot being won or rolled over. The value is an estimate and is not legally binding and EU Lotto and the Operator are not liable for any inaccuracies between the estimated jackpot and the actual jackpot;
- acknowledge that if a lottery draw does not take place or no draw result is published or officially announced or the bets could not be accepted for a particular draw, all valid Bets on that Betting Event will stand for the rescheduled draw or the next available relevant draw; other than in respect of valid Bets placed on (i) Austrian Lotto, Austrian Joker, Spiel77, El Gordo Primitiva, Summer Lottery, El Niño, French Lotto, Irish Lotto, Irish Lotto +1, Irish Lotto +2, Polish Lotto, Polish Lotto+, Swiss Joker, Mark Six, Keno 24/7, KeNow, Cash4Life, German Keno, GlücksSpirale, MULTI, Swedish Lotto Plus 1, Swedish Lotto Plus 2, Swedish Joker Plus, Drömvinsten Plus or Mexico Melate, where all valid Bets will stand and the Underlying Lottery will be replaced with a lottery-style draw using the RiNG technology that will take place at the same time as the official and/or state-run lottery draw was scheduled to take place; or (ii) SuperEnalotto, where all valid Bets will stand for the draw of SuperEnalotto GO (using the certified random number generator "RiNG") that takes place either at the same time as the original draw or, if none, the next available SuperEnalotto GO draw. The deadline for submission of Bets will be displayed on the Operator's Website. Instructions to place or the apparent placement of a Bet after the submission deadline and/or after the start of a specific draw or a draw that has actually occurred will not be valid, irrespective of any automatic confirmation that may be generated or irrespective of a wrong deadline displayed on the Operator's Website;
- acknowledge where these Supplemental Game Terms are published in several languages, the English version of these Supplemental Game Terms will supersede and take precedence over any conflicting elements with other languages.
- WINNINGS FOR BETS ON LOTTERIES
- Payment of Winnings. In the event that a Bet is a winning Bet:
- a calculation of the total monetary value of the Winnings will be carried out;
- if required the Operator will request the completion of certain Player verification tasks. In particular, all tier 1 payouts in respect of Bets on the outcome of Betting Events are subject to enhanced player verification, third party audits on win validation and payout by the underlying insurers; and
- after completion of such verification tasks, assuming no valid issues that may have been identified remain unresolved, the Winnings will be made available to the Operator. For the avoidance of doubt, EU Lotto shall have no liability to the Player in respect of the Winnings.

As is common with MUSL Mega Millions and Powerball, EU Lotto may also pay out the Winnings in a Type A Prize Category over 30 years (the "Annuity Option"). If EU Lotto chooses the Annuity Option, the first payment will be made as soon as possible after the draw, with the next 29 payments at one-year intervals. The level of payments is calculated such that the payments rise by the percentage set by MUSL from time to time until the full sum has been paid out. If EU Lotto chooses the option to pay out Type A Prize Category Winnings in one lump sum ("Cash Option"), the Winnings are paid after withholdings and deductions are made, as it is done in MUSL Mega Millions and Powerball. As an example, if the relevant discount rate is 40%, our Type A Winning is 60% of the Type A jackpot amount after the relevant deductions have been made. It is in EU Lotto's discretion to choose the payout plan.
Withholdings for Prizes in MegaMillions and PowerBall: EU Lotto retains 38% withholdings of prizes in the highest three prize categories because it is intended to put Players in a similar economic position as if they had played the underlying lottery.

The Winnings payable in respect of each Bet in a Type A Prize Category (as defined in the table above), will depend on the number of the Underlying Lottery winning tickets in that Prize Category, the number of EU Lotto Winning Bets in that Prize Category, the payable Prize by the Underlying Lottery Operator for the Underlying Lottery winning tickets in that Prize Category as well as the Underlying Lottery Jackpot in that Prize Category. EU Lotto calculates the Winnings in a Type A Prize Category on the basis of the amount of aggregate stakes published by the Underlying Lottery Operator as well as the distribution to that Jackpot Prize Category or on the basis of the jackpot published on the website of the Underlying Lottery Operator for that Prize Category of the relevant draw of the Underlying Lottery.
ONLY ONE EU LOTTO WINNING BET IN A TYPE A PRIZE CATEGORY
If there is only one EU Lotto Winning Bet in a Type A Prize Category, the Winnings payable in respect of this EU Lotto Winning Bet are calculated as:

EXAMPLE 1: There is only one EU Lotto Winning Bet in the Type A Prize Category and no Underlying Lottery winning ticket has been announced by the Underlying Lottery Operator in the Type A Prize Category in respect of an Underlying Lottery Jackpot in the Type A Prize Category of 90,000,000.00 EUR. The Winnings payable in respect of that single EU Lotto Winning Bet amount to 90,000,000.00 EUR.
EXAMPLE 2: There is only one EU Lotto Winning Bet in the Type A Prize Category and two Underlying Lottery Jackpot winning tickets have been announced by the Underlying Lottery Operator in the Type A Prize Category in respect of an Underlying Lottery Jackpot in the Type A Prize Category of 90,000,000.00 EUR. The Winnings payable in respect of that single EU Lotto Winning Bet amount to 30,000,000.00 EUR.
MORE THAN ONE EU LOTTO WINNING BET IN THE TYPE A PRIZE CATEGORY
If there is more than one EU Lotto Winning Bet in the Type A Prize Category, the Winnings payable in respect of the EU Lotto Winning Bets in the Type A Prize Category are calculated based on a "Share Model", consisting of three steps.
Step 1 – Calculation of the number of shares:
Number of shares = Number of Underlying Lottery Jackpot winning tickets in that Prize Category + Number of EU Lotto Winning Bets in that Prize Category
Step 2 – Calculation of Size of each share:
Size of 1 share = Underlying Lottery Jackpot in that Prize Category / Number of shares
Step 3 – Allocation of Winnings:
1 share per EU Lotto Winning Bet in the Type A Prize Category
EXAMPLE 3: There are two EU Lotto Winning Bets in the Type A Prize Category and one Underlying Lottery Jackpot winning ticket has been announced by the Underlying Lottery Operator in the Type A Prize Category in respect of an Underlying Lottery Jackpot in the Type A Prize Category of 90,000,000.00 EUR. There are three payout shares, with a size of 30,000,000.00 EUR each. The Winnings payable in respect of each EU Lotto Winning Bet in the Type A Prize Category amounts to 30,000,000.00 EUR.

The Winnings payable in respect of that single EU Lotto Winning Bet amount to 9,000,000.00 EUR.
EXAMPLE 2: There is only one EU Lotto Winning Bet in a Type B Prize Category and two Underlying Lottery Jackpot winning tickets have been announced by the Underlying Lottery Operator in that Type B Prize Category in respect of an Underlying Lottery Jackpot in a Type B Prize Category of 9,000,000.00 EUR. The Winnings payable in respect of that single EU Lotto Winning Bet amount to 3,000,000.00 EUR.
MORE THAN ONE EU LOTTO WINNING BET IN A TYPE B PRIZE CATEGORY
If there is more than one EU Lotto Winning Bet in a Type B Prize Category, the Winnings payable in respect of these EU Lotto Winning Bets are calculated based on a share model, consisting of three steps:
Step 1 – Calculation of the number of shares:
Number of shares = Number of Underlying Lottery winning tickets in that Prize Category + Number of EU Lotto Winning Bets in that Prize Category
Step 2 – Calculation of Size of each share:
Size of 1 share = Underlying Lottery Jackpot / Number of shares
Step 3 – Allocation of Winnings:
1 share per EU Lotto Winning Bet in that Prize Category
EXAMPLE 4: There are two EU Lotto Winning Bets in a Type B Prize Category and one Underlying Lottery winning ticket has been announced by the Underlying Lottery Operator in that Type B Prize Category in respect of an Underlying Lottery Jackpot in a Type B Prize Category of 3,000,000.00 EUR. There are three payout shares, with a size of 1,000,000.00 EUR each. The Winnings payable in respect of each EU Lotto Winning Bet in that Prize Category amount to 1,000,000.00 EUR.
- WINNINGS IN A TYPE C PRIZE CATEGORY. The Winnings to be paid out in respect of each winning Bet in a Type C Prize Category (as defined in the table above, for example Prize Category 4 in EuroMillions) shall be the amount of the Prize announced by the Underlying Lottery Operator in respect of an Underlying Lottery winning ticket in the respective Prize Category. If the Underlying Lottery Operator has not announced a Prize in the respective Prize Category for the relevant draw of the Underlying Lottery, the Winnings payable in respect of each winning Bet in that Prize Category will be calculated on the basis of the aggregate amounts paid in for the relevant draw of the Underlying Lottery announced by the Underlying Lottery Operator and its allocation to the winning Prize Categories.
- PAYOUT OF CERTAIN PRIZE CATEGORIES TO OTHER PRIZE CATEGORIES. The above regulations apply based on the assumption that there was no payout of Prizes from one Prize Category to another Prize Category, regardless of whether the rules of the Underlying Lottery indicate otherwise. Therefore, in the event Prizes of a higher Prize Category are added to a lower Prize Category, due to either (i) no Underlying Lottery Winning Tickets in a Prize Category for one draw, (ii) no Underlying Lottery Winning Tickets in the higher Prize Category for a number of subsequent draws or (iii) to a jackpot cap in respect of the higher Prize Category, this will not be taken into account by the Operator. The Operator will only payout the Prize originally allocated to that lower Prize Category based on the stakes published by the Underlying Lottery and the Prize allocation table of that lottery.
- SPECIALJACKPOTS. For all games, the Operator has the possibility to announce a SpecialJackpot under its sole discretion. In this case, the SpecialJackpot sum announced replaces any Underlying Lottery Jackpot in that Type A Prize Category.
- ONE PRIZE CATEGORY. Only one Prize Category can be won per Bet, which will be the highest of the available Prize Categories achieved by, and relevant to, that Bet. A Combo Bet can win in more than one Prize Category, based on the separate Bets it is made of.
- CURRENCIES. Winnings are calculated and credited in EUR. The exchange rate used is the European Central Bank Euro foreign exchange reference rate published on the respective draw date on the ECB website (ecb.europa.eu) or (if ecb.europa.eu is not available) the spot rate of exchange (the closing midpoint) for that currency into EUR on the respective draw date as published on oanda.com provided that, in each case, if such date is not a Business Day, the relevant rate shall be that published the preceding Business Day. "Business Day" for the purposes of this clause means a day (other than a Saturday or a Sunday) on which banks are generally open for business in Gibraltar, London and Frankfurt. This clause also applies for annuity payments. However, EU Lotto may, in its sole discretion, chose to calculate and credit Winnings in the currency in which the Bet was placed.
- DISPLAYED INFORMATION. EU Lotto will not be liable for any mistakes in respect to the information displayed.

ADDITIONAL TERMS FOR ALTERNATIVE SERVICE (APPLICABLE TO MILLIONAIRE PLUS (ALSO REFERRED TO AS EUROPE MILLIONS), MEGA MILLIONS, POWERBALL (ALSO REFERRED TO AS US POWERBALL), AND SUPERENALOTTO (ALSO REFERRED TO AS SUPER ENALOTTO)). In the event that Type A Prize Category exceeds EU Lotto's Jackpot threshold as defined on the product FAQs page on the website (the "Jackpot Threshold"), instead of placing a Bet on the outcome of the relevant Underlying Lottery (as detailed in the table at clause 2(b) (Calculation of winnings)), Players will be requesting that EU Lotto purchases a ticket ("Ticket") via EU Lotto's ticket agent ("Alternative Service") bearing the same number as those selected by the Players on the following alternative draws ("Alternative Draws"):

Alternative Draw: The lottery draw whose results are derived from SisalNote that EU Lotto or its ticket agent will be the participant in the lottery draw whose results are derived from the Alternative Draw. The Player does not participate in the lottery draw and obtains no right to possession of the Ticket. The Player therefore contracts with EU Lotto only and not with the lottery operator nor any third party ticket agents of EU Lotto. The Player has only a contractual entitlement to receive the payment of winnings received by EU Lotto in respect of any winning Ticket, subject to any deductions or exclusions outlined below.
If a Player has placed a Bet (including under a Duration Bet or Subscription) on the outcome of the relevant Underlying Lottery (as detailed in 17.3 (Calculation of winnings)) prior to the Type A Prize Category exceeding the Jackpot Threshold, that Bet will automatically become void. The Player's Stake paid in respect of the applicable Bet will instead automatically be applied to participate in the Alternative Service. For a Duration Bet or Subscription, once the Type A Prize Category no longer exceeds the Jackpot threshold, Alternative Service shall not apply and the placing of Bets shall resume as normal.
In respect of Millionaire Plus (UK Players: Millionaire) only, it is important to note that the winning numbers in respect of a Bet placed on the outcome of Rychlé kačky will be different to those of the lottery draw whose results are derived from Österreichische Lotterien GmbH (draws taking place in Paris every Tuesday and Friday evening). When participating in the Alternative Service, in purchasing Tickets, EU Lotto is not responsible for the issuance of tickets or promoting the draw, which is the responsibility of the lottery promoter in the relevant jurisdiction. EU Lotto, through its network of ticket agents, will make reasonable endeavours to procure that the ticket agent fulfils the Ticket orders placed by EU Lotto, however EU Lotto will not be liable to the Player in the event that the ticket agent fails to fulfil (or fulfil correctly) any the Ticket order.
When participating in the Alternative Service, EU Lotto cannot guarantee the collection of winnings in instances where, despite EU Lotto's reasonable efforts, a lottery operator has declined to pay EU Lotto or its ticket agents, or EU Lotto has otherwise been unable to recover such winnings. EU Lotto will make every reasonable effort to collect winnings and expedite payment to the Player of such winnings.
Please note that any payment of winnings from such tickets will be in line with the actual payout of from the underlying lottery ticket, which is intended to put the Player in a similar economic position to the position the Player would be in if the Player had played the lottery draw whose results are derived from the Alternative Draw.
- Definitions
"Bet" - a bet on the outcome of an Underlying Lottery and/or Underlying Lottery Jackpot.
"Combo Bet" in a combo Bet all possible combinations of the selected numbers are classified as separate Bets
"Excluded Lists" - means any of the following: (i) any person, citizen of, or resident in a country listed by the Financial Action Task Force ("FATF") as being a high risk jurisdiction subject to a call for action as communicated from time to time by the FATF (Including at: www.fatf-gafi.org); (ii) any person listed on the Financial Sanctions List of HMRC, as varied from time to time; and (iii) any person citizen of or resident in the United States of America, Cuba, Syria, Venezuela, Russia, Ukraine or Belarus.
"FATF" - Financial Action Task Force
"Jackpot" - in the case of a Bet, the maximum possible winning at EU Lotto in respect to the underlying draw of the relevant Prize Category/Prize Categories of the relevant lotteries
"Game Overview" - the calculations as set out in these terms and conditions under the heading "Calculation of Winnings".
"SpecialJackpot" - in the highest Prize Category communicated by the Operator in regards to an EU Lotto game, if that sum is higher than the published jackpot of the relevant underlying lottery.
"EU Lotto Group Company" - any entity directly or indirectly controlling, controlled by, or under common control with EU Lotto. For the purpose of this definition, "control" (including, with correlative meanings, the terms "controlling", "controlled by" and "under common control with") means the power to manage or direct the affairs of the entity in question, whether by ownership of voting securities, by contract or otherwise.
"EU Lotto Winning Bet" - a winning Bet placed on the Operator's Website, which was successfully submitted, via the Internet, and placed by the Operator on behalf of Players with EU Lotto, and, including possible winning Bets introduced through a third party to EU Lotto and then placed by a third party on behalf of a player with EU Lotto.
"Operator" - Maple International Ventures Limited
"Operators' Website" - means the website accessible by Players operated by the Operator which is www.lottomart.com or www.lottomart.co.uk and any mobile applications
"Pay Out" - the amount, which the operator of an Underlying Lottery has to pay out or has already paid out, in respect to a correctly matched Bet of a relevant draw in a relevant Prize Category
"Player" - a registered user of the Operator's Website.
"Prize Category" or "Prize Tier" -the total amount of numbers correctly matched by any player who has placed a bet with EU Lotto or any company within its group, the Operator or any other operator, by whatever means, (including but not limited to Super Numbers, Stars, Euro Numbers, Powerballs, Megaballs, Bonus Balls and/or others as applicable) determines the Prize Category in respect of the relevant draw of a certain lottery or a relevant game, as announced in the official rules of the Underlying Lottery.
"Type A Prize Category" - a Prize Category where the payout to Players depends on the total number of EU Lotto Winning Bets and Underlying Lottery Winning Tickets in that Prize Category, as defined in the EU Lotto Game overview.
"Type B Prize Category" - a Prize Category where the payout to Players depends on the total number of EU Lotto Winning Bets and Underlying Lottery Winning Tickets in that Prize Category, as defined in the EU Lotto Game overview.
"Type C Prize Category" - a Prize Category where the payout to Players is independent from the number of EU Lotto Winning Bets and Underlying Lottery Winning tickets in that Prize Category, as defined in the EU Lotto Game overview.
"Underlying Lottery" - a lottery that an EU Lotto game is based on.
"Underlying Lottery Jackpot" - the aggregate amount payable by the Underlying Lottery Operator in respect of all Underlying Lottery Winning Tickets in a Type A or Type B Prize Category in respect of the relevant draw of the Underlying Lottery, as announced by the Underlying Lottery Operator or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the Underlying Lottery Operator had there been an Underlying Lottery Winning Ticket in that Jackpot Prize Category in respect of the relevant draw.
"Underlying Lottery Operator" - the organisation that organises or co-organises the Underlying Lottery.
"Winnings" - this refers to the amounts to be paid to Players in respect of EU Lotto Winning Bets.

PLAYING SCRATCH CARDS
- The Scratch Cards are virtual games of chance where the results are decided by a certified and tested random number generator. The exercise by you of any skill or judgement will have no impact on the outcome of any scratch card game.
- Scratch cards are purchased in advance in quantities of one or more. The cost of the Scratch Card is fixed and is displayed before you purchase the Scratch Card(s).
- All Scratch Card purchases are final and non-refundable even if unplayed, save for in accordance with the Terms of Use.
- Scratch Cards purchased via Payment Card or other Payment Method are only valid for play when we have received payment in full. In the event that we do not receive payment in full the relevant Scratch Cards will be voided (cancelled) and any Winnings will be forfeited.
- Purchase confirmation receipts for Scratch Cards will be visible in your transaction history.
- Purchased and unplayed Scratch Cards will be added to the "My Buys" section of the Site for you to access and play. Once played, the results of each completed Scratch Card will appear in the "History" section of "My Buys" within the Site.
- To play a Scratch Card select it from the My Buys section by clicking "Play Now" on the relevant Scratch Card.

- Lottomart is entitled to discontinue offering a particular Scratch Card at any time. In the event that you have purchased a discontinued Scratch Card that remains unplayed at the time it is discontinued, we are entitled to void the Scratch Cards and refund the purchase value (whether by Cash or Diamonds corresponding to how the relevant Scratch Card was acquired) to your Player Account.
- Only one prize may be won per Scratch Card unless otherwise stated.

PLAYING GAMES
- The results of the Games are decided by a certified and tested random number generator. The exercise by you of any skill or judgement will have no impact on the outcome of any Game.
- You fully accept and agree that random number generator software will determine all outcomes of Games. In the event of a discrepancy between the results displayed on your device and a Game's records on our server (or those of our licensors), our records and those of our licensors shall be regarded as definitive.
- You acknowledge and agree to be bound by any additional rules which appear within a Game, including within a Game's "Help" or "Game Info" tabs ("Game Rules"), including rules relating to minimum and maximum bets, maximum payouts, jackpots, disconnections and system malfunctions. The Game Rules may also contain instructions on how to play and the applicable Pay Table. By playing the Games, you agree to be bound by the Game Rules and any additional end user terms and conditions of any third-party provider of any of the Games.
- Each set of Game Rules may be accessed in each Game. If there is any conflict or inconsistency between these Terms and Conditions and the different sets of Game Rules, then these Terms and Conditions shall prevail.

- You shall not interfere, interrupt, attempt to interrupt or attempt to manipulate the normal play of any of the Games thereon including but not limited to the use or attempted use of any artificial intelligence or player assistance.
- We may void any Games and we shall not be liable to pay any Winnings to you in respect of any Game if fraud, technical or human error, or unauthorised influence is found in conjunction with any Games or random number generator used in connection with any Game.
- If you experience any disconnection from the Site for any reason whilst playing any of the Games, the following shall apply:
- If the disconnection occurs during a Game where further action is required by you, then the Game will be resumed from that point when you log back in and re-launch the relevant Game. If you do not re-launch the Game within forty-eight (48) hours of the disconnection occurring, then you will be deemed to have lost the incomplete Game and your Game Wager will not be refunded.
- If the disconnection occurs during a Game where no further action is required by you, then the Game will be played through by our game servers and settled accordingly. The result will be displayed in the gambling history in the Transaction section of your Player Account.
- We are entitled to suspend, discontinue, modify, remove or add any Game at our discretion with immediate effect and without any obligation to provide you with notice and we will not be liable as a result of any such action.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. Whilst we accept and recognise your right to freedom of expression during online communications, it is a condition of your use of the Site that your participation in our chat room adheres to the levels of courtesy and politeness that we require from all of our players and that you do not direct any inappropriate or inflammatory words, comments or phraseology during online communications (including but not limited to anything that we deem to be abusive, defamatory, obscene or racist), whether directed at other players, hosts, dealers or any other person or entity. SUSPENSION AND CLOSURE OF PLAYER ACCOUNTS
- We may suspend or close your Player Account at any time. We will notify you reasonably in advance of any such action on our part, except where we discover or suspect (acting reasonably) that you have engaged in a Prohibited Activity, in which case such action may take effect without notice following the process set out below.
- If we have reasonable grounds to suspect that you have engaged in any Prohibited Activity, we will restrict or suspend your Player Account without notification, and your Player Account will remain restricted/suspended while the matter is investigated. You agree to cooperate fully with any such investigation. Your funds cannot be accessed or withdrawn during periods of suspension, and any Cash Balance will remain in the Player Account. We will use reasonable efforts to undertake our investigation within a reasonable period, but you acknowledge that any delay on your part to respond to our information or other requests will affect our ability to do so. If our investigation results in our decision (acting reasonably) that the issue has been resolved to our satisfaction, we will lift the Player Account restriction/suspension. If our investigation results in our decision (acting reasonably) that you have engaged in any Prohibited Activity, we will permanently close your Player Account. In these circumstances, your details may be passed on to any applicable regulatory authority or any other relevant external third parties.
- We may also be required to suspend or close your Player Account in order to comply with our legal or regulatory obligations or if we are requested to do so by the police, by any regulatory authority or by any court or other competent authority.
- If we close your Player Account, any Cash Balance in your Player Account at the time of such closure will be returned to you except that: (i) if you have engaged in illegal activity, we are under no obligation to refund to you any money that may be in your Player Account; and (ii) if we discover or determine (acting reasonably) that you have participated in any Prohibited Activity then we will withhold all or part of the Cash Balance and/or void or recover from your Player Account deposits, pay-outs, bonuses/promotions, and/or any Winnings (if/as applicable) in each case to the extent attributable to such Prohibited Activity/ies.

OUR COMPLAINTS PROCEDURE
- If you wish to raise a complaint, we encourage you to do so as soon as possible and, in any event, within six months of the date of the incident. We regard complaints received as opportunities to demonstrate our commitment to a high-quality customer experience by quickly and positively responding to and resolving your complaint. We also value these interactions as opportunities to learn as to how we can improve our services to our customers.

- When contacting us to make a complaint, please state "complaint" clearly in your email.
- When making a complaint, please provide us with as much detail as possible about what has caused your complaint so that we can consider your complaint as quickly and efficiently as possible. Please include the following details (as applicable):
- Customer identification details - name, email address, account number
- Date of incident
- Details regarding the incident and any additional relevant information
- We will provide you with an acknowledgement of your complaint within 24 hours.
- Our acknowledgment will include a copy of our Complaints Policy. We will provide you with a copy of our Complaints Policy to you on request.
- On receipt of your complaint we will allocate a reference number to your complaint. Most complaints will, where appropriate, be handled by our Player Experience Team.
- If you are not satisfied with our response to your complaint, we have procedures to escalate your complaint internally for further consideration.
- We aim to provide you with a substantive response to your complaint as soon as practically possible and seek to resolve your complaint within eight weeks from the date on which we received your complaint.
- If it takes us longer than eight weeks from the date on which we receive your complaint to investigate and/or resolve your complaint, we will write to you within those eight weeks with a final response, which will confirm that we have either:
- resolved the complaint; or
- agreed we are at a 'deadlock' with you or that we have reached a stalemate and are unable to resolve your complaint.
- Our final response represents the final stage of our internal complaints procedure.
- REFERRAL OF UNRESOLVED COMPLAINTS TO AN EXTERNAL INDEPENDENT ALTERNATIVE DISPUTE RESOLUTION (ADR) PROVIDER - If our final response indicates that we are at a 'deadlock' with you, our final response will provide you with details of how you can refer your complaint to an external independent Alternative Dispute Resolution (ADR) provider for adjudication unless your complaint relates to a matter unconnected to the gambling services we provide (for example, if your complaint relates to the types of product we offer). We call these types of complaints "non-gambling related complaints". We will deal with all non-gambling related complaints internally as these are not appropriate for referral to our ADR provider.
- THERE IS NO CHARGE TO YOU FOR REFERRING YOUR UNRESOLVED COMPLAINT TO OUR ADR PROVIDER. - Customer submission to include details on disputed transactions on an IBAS adjudication form or through the website.
- Operator contacted to provide written submission, documentary evidence and details of any relevant company rules or terms.
- Statement and any evidence submitted is passed on to an independent panel.
- Panellists may have further questions to either party.
- With all submissions received and considered, the panel completes the adjudication.
- The ruling is posted to both parties simultaneously.
- Either party can request for the dispute to be reviewed.
- If you request to use an ADR provider other than the one named above, we may agree to use such an ADR provider but please note if your chosen ADR provider is not approved by the Gambling Commission, there are risks associated with using an unapproved ADR provider. For example, unapproved providers are not bound by the requirements of the ADR regulations, which require them to act in a fair, transparent and open manner. You may use our named approved ADR provider even if you have already used an unapproved ADR provider.
- We aim to respond to requests for information about disputes from the ADR provider in full within 10 days of receiving the request.
- Please note that the ADR provider is entitled to reject disputes referred to it on the basis that they are frivolous or vexatious, but we are not permitted to refuse referral on that basis.
- The ultimate resolution of your complaint (arrived at with the assistance of the ADR provider) shall be binding on both parties, if agreed by you in advance of the ADR process starting.
- If you are not a customer registered in or transacting in Great Britain, you shall be entitled to refer a complaint to the Gibraltar Gambling Commissioner. Please refer to the Government of Gibraltar website for further information and advice on how to do so:
- You may also use the Online Dispute Resolution (ODR) platform to resolve your complaint. A link to the platform is provided at https://ec.europa.eu/consumers/odr/main/
- The ODR platform allows you to file, and Lottomart to respond to and handle complaints online (including complaints where you and Lottomart are in different countries within the EU).
- If you choose to use the ODR platform, you will need to select IBAS when the option for remote gambling service providers appears.
- The ODR process works as follows:
- you will need to complete the form as a client
- select IBAS as the specific dispute resolution body
- a copy of the complaint will be sent to IBAS and to Lottomart.
- The ODR Provider has 3 weeks to decide if it is a valid complaint or to decline the complaint.
- Where a dispute has been referred to the independent body using ODR, it will be dealt with according to the latest dispute resolution process specified by the relevant independent body. You agree that their decision shall be final and binding on you and us.
- We are required to keep a record of all customer complaints and disputes.
- For customers registering or transacting in Great Britain, we are required to: (i) provide the Gambling Commission with a copy of the decision, or a note of the outcome of each dispute referred to an ADR entity; (ii) notify the Gambling Commission of any outcome adverse to us (in whatever jurisdiction) of any proceedings taken against us by a customer in relation to a gambling transaction (but excluding proceedings allocated to the County Court small claims track or equivalent in jurisdictions outside England and Wales).

INSURANCE AND HEDGING ARRANGEMENTS
We are under no obligation to disclose to you the details of any insurance policies, hedging arrangements or other arrangements with any Hedging Partners that we may have in place from time to time.

LIMITATIONS ON OUR LIABILITY
- We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your statutory rights as a consumer. As we made clear in the "Important Information" section at the top of these Terms and Conditions, we will not be liable to you under these Terms of Use, and nor do we owe you a duty of care, in respect of our compliance or otherwise with any regulatory obligations that we may be under from time to time.
- Subject always to section 25.1 above, we shall not be liable to you or any other person for any claims, loss or damage whatsoever arising from or in any way connected with:
- any action or event that prevents or hinders the acceptance of a Bet and/or Game Wager;
- our refusal to accept any Bet or Game Wager, or the purchase of any Scratch Card;
- any losses caused by the misuse or unauthorised use of log in details relating to any Player Account (save to the extent such unauthorised use results from our failure to exercise reasonable care and skill);
- any Error, Malfunction or Interruption or for the failure or malfunction of the equipment or technology used by you or your internet service provider;
- the insolvency of any third party, any Hedging Partner and/or any bank providing banking facilities to Lottomart;
- losses that were not foreseeable by you and us at the time of you first accepted these Terms of Use;
- any use by you of the Services or any content thereof, including where you are in breach of these Terms of Use (including any Prohibited Activity on your part);
- damage to your equipment (e.g. desktop, laptop, mobile, smartphone, tablet, games console or other internet-enabled device) or for any loss or corruption of data that results from your use of the Services, except that if any defective digital content that we have supplied to you damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation;
- our closure, restriction, limitation, or suspension of your Player Account in accordance with these Terms of Use;
- failure or delay by us to provide the Services or to meet any of our obligations under these Terms of Use to the extent that such failure or delay results from events beyond our reasonable control;
- (if you use the Services for any non-personal/business purposes, which you are not permitted to do): (i) loss of profits; loss of business, business interruption, loss of business opportunity; depletion of goodwill; loss or corruption of data or information;pure economic loss; for any special, indirect or consequential loss, costs, damages, charges or expenses however arising under the Terms of Use;
- if we are prevented from or delayed in performing our obligations, or from carrying on our business, by acts, events, omissions or accidents beyond our reasonable control, including, without limitation, strikes, lock-outs or other industrial disputes (whether involving our workforce or the workforce of any of our third party suppliers), failure of a utility service or transport or telecommunications network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood or storm; or
- for any damages or losses that are deemed or alleged to have resulted from or been caused by the transfer of data over communications networks and facilities including the internet, the Site or any errors or omissions in its content, including without limitation any Interruptions.
- Except for our obligation to pay Winnings for successful and valid Bets placed by you and submitted rand accepted according to the Terms of Use, our total aggregate liability to you in contract, tort (including breach of statutory duty), misrepresentation, restitution or otherwise under or in connection with the Services or these Terms of Use shall be limited to the lower of (a) £100,000 (one hundred thousand pounds) and (b) the value of stake paid to us in respect of the Bet or Game Wager or Scratch Card relevant to which the liability in question has arisen.

PROMOTIONAL TERMS
- From time to time we offer promotions and offers to new and existing customers. These promotions and offers will have their own Promotional Terms and you should ensure that you read and understand the specific Promotional Terms for each promotion before participating in a promotion.
- All promotions and offers are limited to one per household and to persons who are aged 18 or over.
- Participation in promotions and/or receipt of bonuses is exclusively at Lottomart's discretion. Lottomart is entitled, at any time and at its sole discretion, to withdraw, revoke, limit or restrict the eligibility of any customer or group of customers, to participate in a particular promotion or bonus that may be made available on the Site. We may also prevent the take-up of new promotions and/or bonuses (and/or the completion of the same) for regulatory reasons including those relating to safer gambling.
- We may at any time carry out an internal investigation to assess whether your participation in any promotion is in accordance with the relevant Promotional Terms and these Terms and Conditions. In addition to the specific Promotional Terms, and in order to comply with our fair play policies, you hereby agree not to engage in any of the following:
- accruing Diamonds or other rewards by using low risk betting patterns including but not limited to low margin betting, equal betting, zero risk bets, hedge betting, doubling systems;
- making deposits to your Player Account solely to take advantage of the promotion and with no intention of playing /risking the funds you deposited with; or
- colluding in any way with others in order to take advantage of any promotion including but not limited participation in any form of syndicated or co-ordinated wagering patterns.
- Some promotions may include the award of free spins on Games. Free spins can only be used on the Game stated in the relevant Promotional Terms and must be claimed prior to the expiry date specified in those Promotional Terms.
- Any disputes arising in connection with any bonus or promotion will be settled in accordance with Lottomart's complaints procedure, as set out at Section 23.
- We can amend or cancel any promotion or Promotional Terms or this section 26 at any time in order to comply with any legal or regulatory change.
- We can amend any promotion or Promotional Terms or this section 26 at any time. Please be assured that we will only make such amendments in order to address or correct any significant issues relating to the relevant promotion, such as software errors or any manifest error in the promotion itself. Any such change will not adversely impact you if you have already started wagering under that promotion.

MAXIMUM WINNINGS
- You acknowledge and agree that all bets placed on Games and Scratch Cards are subject to a maximum daily payment per customer.
- This section 27 does not apply to progressive jackpot Games or to Gaming Products where you bet on the outcome of lotteries.
- The maximum cumulative winnings from Games and Scratch Cards in any one day for any individual player is GBP/EUR 250,000 (depending on your Lottomart account currency), exclusive of stake (the "Maximum Daily Win"). If you win more than the Maximum Daily Win, then you will not be entitled to receive any amount in excess of the Maximum Daily Win. If your account currency is different to the list above, the Maximum Daily Win will be the currency equivalent value of the USD value.
- You acknowledge and agree that the Maximum Daily Win shall apply in all circumstances regardless of the fact that the bets that you place on Games and Scratch Cards may indicate that you have the opportunity to win or have won more than the Maximum Daily Win.

MALFUNCTIONS, ERRORS, AND INTERRUPTIONS
- We try hard to provide you with a high-quality betting and gaming platform, but we cannot guarantee that the Player Account or Services will at all times perform correctly. Various kinds of mistakes and errors can occur – technical, human and otherwise – and you understand and agree that we can only provide the Services to you, and you must accept them, in the condition that we make them available from time to time.
- In this section 28 we set out a description of the things that can go wrong and the rights that we have in such events.
- Below are some key definitions to help you understand this Section:
A "Malfunction" refers to where an automated process fails to operate as designed or intended, for example where a piece of computer software produces a deviation from its intended performance specifications or parameters, or where two pieces of software fail to interface or communicate with each other in the manner intended or designed, in either case so as to produce a result which is not the result that was intended or designed. These malfunctions may or may not be apparent to us or to you and they may only come to light as and when settlement instructions, game outcomes, winnings or cashouts are investigated and analysed retrospectively.
An "Error" refers to a mistake or error that is not exclusively technical, for example the mistaken posting of incorrect odds, the offer of incorrect prices or terms for participation in a promotion or gambling opportunity. Errors can arise from human mistakes, administrative, operational or systems failures and combinations of all of these. For example, a bet might be offered mistakenly at a price that is substantially out of the market or a promotion designed to offer a £5 return might mistakenly advertise a £50 return or the pay-tables advertised for a product may mistakenly fail to reflect the true payment configuration of the product.
An "Interruption" refers to an interruption in a gambling transaction for any reason, for example an interruption caused by the failure of the internet or connectivity, or severe latency in communications, or technical failure due to some disaster or unforeseen event.
Where any of the above occur, we will deal with them as described below and it is important that you understand and agree to the following before you use the Services, as we made clear in the 'Important Information' section at the top of these Terms and Conditions:
- MALFUNCTIONS AND ERRORS
- If as a result of a Malfunction or Error, your Player Account is credited with Winnings that you would not have received were it not for that Malfunction or Error, we will have the right to void the relevant transaction and withhold the relevant Winnings. This applies even if the relevant Player Account could have produced the same or similar amount of winnings without the intervention of the Malfunction or Error and it applies whether the Malfunction or Error was apparent to you or to us or not. If you have withdrawn any such Winnings, you agree that you will pay them back to us as and when we ask you to.
- Where any Malfunction or Error is or becomes apparent or obvious to you or you suspect that a Malfunction or Error may be occurring, you agree that you will cease your use of the relevant Gaming Product(s) immediately and will report it to us immediately.
- INTERRUPTIONS
- Our priority is to ensure that we deal with Interruptions in a way that is fair and does not systematically disadvantage our customers.
- In relation to betting: we are entitled to suspend betting markets, void bets and return stakes to customers.
- In relation to gaming: where an Interruption occurs after we receive notification of your gamble and where you can have no further influence on the outcome of the event or gamble, the results of the gamble will stand; where an Interruption to a single-participant single stage event occurs before an outcome has been generated we will return your stake to your Player Account; for games where there are multiple stages or decision points we will take all reasonable steps to restore the game to its last known state prior to the Interruption to enable you to complete the game; for games with multiple participants (equal chance or otherwise) we will deal with these as seems fairest to us (acting reasonably) on a case-by-case basis; and for games that are progressive jackpots, progressive jackpot values will be restored to their pre-failure state to the extent it is within our control and not the games provider.
